Geek Support Web Development Services

All prices are in Australian Dollar. 

Contract:

The client`s approval for work to commence shall be deemed a contractual agreement between the client and Amplify.

Important:

Approval for the work to commence and payment of the advance fee indicates that the client accepts these terms and conditions. An advance payment of 30% of the total cost of the project is required before work can commence. After work commences this deposit is non-refundable. For projects under the value of $400, full payment will be asked for before commencing on your work.

Quotations:

The price quoted to the client is for the work agreed upon, which will be listed in the quotation. Should the client decide that changes are required as the site is developed, the cost of this additional work will be mentioned at that time and added to the project quotation, with this appearing on the final invoice.

Material:

All material supplied by the client shall remain the client`s property. It will be assumed that this material belongs to the client and that it does not breach any copyright laws. Geek Support will not be held responsible (or liable) for any content that is used within the design of a clients`s website. Geek Support will retain the copyright of any material, including the source code, created for the client by Geek Support until payment of the final invoice. Source code is released under the GNU Public License GPL. At this time the mentioned material will become the property of the client.

.png and .fla files are not included within the content that is provided to the client. A separate agreement must be made in order to obtain these files.

Website Marketing:

Geek Support are not responsible for the client`s on-going web site promotions. Should the client require the web site to be promoted, a separate contract must be agreed. Amplify can make no guarantees about the success of a website in the search engines and any search engine promotion activity done on the customers behalf, because this is controlled by the search engines.

Guarantee:

All development work by Geek Support is guaranteed for a period of 30 days. Only listed services in your project quotation will be covered. Within this period you will be able to use/test your website for any programming faults. Bug fixes will be provided free within this period only.

Future Support:

The completed website or development work is provided as a complete work. Geek Support are not responsible to provide support once project completion. Amplify can provide future support upon request but there can be no guarantee of future support unless an ongoing support package is negotiated. Training in the use of your online store enviroment or content management system is not the responsibility of Geek Support. It is at Geek Support`s discretion how much training will be provided to a client about their products. Often training time is specified within your quotation and a separate contract for training can be organised at any stage. If you are running a site that is built upon open-source or other software applications; (eg: Joomla Content Management System, ZenCart e-commerce, OsCommerce) . Please Note that it is not the responsibility of Geek Support to maintain upgrades to these frameworks unless an agreement for this has been created. We are more than happy to provide an upgrade service for your software upon request, please contact us to find out more information about this.

Payment:

Payment is currently accepted by cheque (in $AUD),  by using a Credit Card (Paypay Servers) and by Bank Transfer into Geek Support`s account, unless otherwise agreed. If your cheque is returned by the bank as unpaid for any reason, you will be liable for any "returned cheque" charges. Payment on all development services will be due within 3 days of final invoice. Full publication of the Web Pages and ownership of the content may not take place until full payment has been received. Any material previously published may be removed and the site stored to its orignal condition if payment is not received. Full project payment will be due no later than 30 days from the start date of your project. These terms are in place so that projects do not spread over long periods, due to unsupplied website content or information.

Disclaimer:

Geek Support will not be responsible for any damages your business may suffer while using our development services. Geek Support disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Geek Support and its employees. Geek Support makes no "uptime" guarantees for your website except those from our suppliers, in which case theirs Terms of Service will apply. Geek Support can accept no responsibility for any loss of data or consequences arising from the loss of your website content. Geek Support always advises clients to back up their site data regularly for their own protection. The Client agrees that they shall hold Geek Support (or it's employee's/owners) harmless from any and all demands, liabilities, losses, costs and claims, for web development products and services supplied by Geek Support.

Notes: Should Geek Support waive any of these terms on an individual basis, this shall not affect the validity of remaining clauses or commit Geek Support to waive the same clause on any other occasion. By agreeing to these terms and conditions your statutory rights are not affected. We ask that a linkback is placed on all websites that we provide work on. Linking is good way to help promote your website and we also link to your site and help promote your website by listing on our project portfolio. This linkback is a requirement and will be placed in-view on your website pages or if you require can be hidden from view. Amplify reserves the right to change or modify any of these terms or conditions at any time. Should clarification of any of the above be required please contact us.
